This Privacy Policy (this “Privacy Policy”) describes how ("Pythagoras", "we", "our", or the "Company") collects, uses, stores and discloses certain personal information obtained through our website at https://getpythagoras.ai (the “Site”), through our mobile application (the “App”), and through our related services, content, tools, software, APIs, and products (together with the Site and App, collectively, the “Services”). By using the Services, you consent to the collection and use of your information by Pythagoras in accordance with terms of this Privacy Policy and to our Terms of Service.

If you do not agree to this Privacy Policy, you may not use the Services. Pythagoras may amend, modify or make other changes to this Privacy Policy without notice. Changes will become effective on the date that the revised Privacy Policy is posted to the Site. You should check the Site frequently to see any changes. If you use any Services following a change in this Privacy Policy, you agree to be bound by any changes in the revised Privacy Policy. Please note that this Privacy Policy applies only to information collected via the Services – it does not apply to information you disclose to Pythagoras through other means.

PYTHAGORAS IS NOT A HEALTH CARE PROVIDER AND NO HEALTH CARE PROVIDER/ PATIENT RELATIONSHIP IS CREATED WHEN YOU USE THE SERVICES. PYTHAGORAS DOES NOT PROVIDE ANY MEDICAL ADVICE, THERAPY, MENTAL HEALTH TREATMENT, DIAGNOSIS, PHARMACY SERVICES OR OTHER TREATMENT AND IS NOT A SUBSTITUTE FOR THE SERVICES PROVIDED BY HEALTH SERVICES PROVIDERS (COLLECTIVELY, “PROVIDERS”).

We May Collect the Following Kinds of Information When You Use the Services

We collect personally identifiable information (“Personal Information”) and other non-personally identifiable information from you when you register or otherwise use the Services, visit the Site or respond to a communication from us such as a telephone call or e-mail.

You will be required to provide certain Personal Information to use certain features of the Services. For example, new users may be required to provide their full name, e-mail address, phone number, address, username and password, additional demographic information, payment or insurance information or other Personal Information. If you become a user of the Services (a “User”), your Provider will have access to Personal Information in order to provide you with health care services.

In the course of using the Services, we may collect your medical information, including without limitation descriptions of medical and mental health status, audio recordings or transcriptions thereof, descriptions and images of your mood, affect, cognitive functioning, symptoms, medical history, diagnoses, assessments, recommendations, medication and drug use, whether in real time or offline, as disclosed by you or as inputted by a clinician. Any personally identifiable information (“PII”) or Protected Health Information (“PHI”) (as defined by the Health Insurance Portability and Accountability Act (“HIPAA”) and related state data privacy laws) that you share with us through the Services will be collected and used in accordance with this Privacy Policy. Only the definitions of PII and PHI that apply in your location will apply to you under this Privacy Policy.

You understand and agree that Pythagoras records and stores audio PII, or transcriptions thereof, communicated through the Services by you or on your behalf, including in your communication with Providers using the Services.

We may collect and use your IP address, UDID (Unique Device Identifier) or other persistent user and/or device tokens, geolocation, device type, operating system, browser type and version, screen resolution, browser and keyboard language, your 'click-stream' and activities on the Services, the period of time you visited the Services and related timestamps identifiers to operate the Services, analyze user activities and interests, and to otherwise gather information about individual users.

We use and may allow third party service providers to use cookies, pixels, and other tracking technologies (collectively, "cookies") to recognize your browser or device, provide and enhance the Services, learn more about how you use the Services and your interests, and for additional purposes, including: (i) conducting research and diagnostics to improve our products and services, (ii) preventing fraudulent activity, and (iii) improving security (collectively, “Usage Data”).

You can manage browser cookies through your browser settings. The 'Help' feature in most browsers will allow you to restrict your browser from accepting new cookies, have the browser notify you when you receive a new cookie, and block cookies. If you block all cookies on your browser, neither we nor third parties will transfer cookies to your browser. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some features and services may not work.

We may also collect certain other non-personally identifiable information.

How We Use and Process Your Information

You authorize Pythagoras to use the Personal Information and other data we collect from you when you register, access or use the Services, or respond to a communication from us in the following ways:

We reserve the right to make full use of Usage Data.

If you are using any Services from a country outside the United States and provide Personal Information to Pythagoras, you authorize and consent to the transfer of Personal Information about yourself to the United States. You understand that the privacy laws of the United States may be different from and not as comprehensive or protective as those in your country. Personal Information collected on the Services may be stored and processed in the United States or abroad.

Sharing Information with Third Parties

You understand and agree that we may disclose your Personal Information and other data to third parties, as follows:

To our affiliates in order to provide our products, services and effective customer support.

To third parties, including your Providers, software systems utilized by your Provider, pharmacies and labs, consultants, strategic partners and other third parties we engage to provide our products and services, including customer support, website hosting, artificial intelligence processing, software development, order processing, payment processing and analytics services.

In aggregate or de-identified form, for purposes of analytics, research, marketing and other business interests of Pythagoras. Such use shall not include Personal Information or information that can identify you as an individual or reasonably be used to identify you.

In connection with the sale or transfer of Pythagoras, or any portion of our assets, or in connection with a business acquisition transaction.

In connection with regulatory and other governmental requests or legal process; in connection with any legal or professional reporting obligation, including to protect the safety and welfare of users or third parties; to enforce legal rights or defend against claims.

Retention of Personal Information

We will process and retain Personal Information you provide for as long as we believe is necessary or advisable to carry out Pythagoras’s intended business purpose for such information, or to comply with applicable laws, contracts, or other rules or regulations. We are legally required to retain certain medical records subject to applicable medical record retention laws, even after account deletion.

Correcting or Deleting Your Personal Information

If you wish to correct or update your Personal Information, you may do so in the Services or by contacting us at contact@getpythagoras.ai.

If you wish to delete your account, you may do so by (i) accessing the settings section of the Site or App or (ii) by contacting us at contact@getpythagoras.ai. We will delete any Personal Information pursuant to any applicable privacy laws or otherwise de-identify such Personal Information and thereby transform it to become non-Personal Information. Please note that medical records must be retained pursuant to applicable medical record retention laws. While we will delete your account and associated data that is not legally required to be retained, we will retain your medical records subject to and in compliance with applicable medical record retention laws.

Privacy of Minors

Only individuals 18 years of age or older are permitted to use the Services, either for themselves or on behalf of their minor dependents. We do not knowingly collect information directly from minors under the age of eighteen.

“Do Not Track”

Please note that our Services do not recognize “Do Not Track” signals and requests.

Third Party Sites

Our Services contain links to third-party sites that are not owned or controlled by Pythagoras. Please be aware that we have no responsibility or liability for the privacy practices or content of such other sites. We encourage you to be aware when you leave our Site (or the Services) and to read the privacy statements of each website that collects personal information.

These additional disclosures satisfy the requirements of the California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act:

Categories of personal information collected. The personal information that we collect, or have collected from consumers in the twelve months prior to the effective date of this Disclosure, fall into the following categories established by the California Privacy Rights Act:

Your Data Rights: You may have certain data rights under state privacy laws, including requesting information about the collection of your personal information by us, accessing your personal information in a portable format, and correcting or deleting your personal information. If you wish to take any of these actions, please email contact@getpythagoras.ai. We do not engage in cross-context behavioral advertising.

No sale of personal information. In the twelve months prior to the effective date of this Disclosure, we have not sold any personal information of consumers, as those terms are defined under the California Privacy Rights Act.

California Privacy Rights Act Sensitive Personal Information Disclosure. The categories of data that we collect and disclose for a business purpose do not include "sensitive personal information" as defined under the California Privacy Rights Act. We do not use or disclose sensitive personal information for any purpose not expressly permitted by the California Privacy Rights Act.

California Privacy Rights Act Retention Disclosure. We keep your personal information for as long as it is required in order to fulfill the relevant purposes described in this privacy notice, as permitted or as may be required by law, or as otherwise communicated to you.

California Privacy Rights Act Non-discrimination Statement. We will not discriminate against any consumer for exercising their rights under the California Privacy Rights Act.

California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act De-identified Data Disclosure. We may use de-identified data in some instances. We either maintain such data without attempting to re-identify it or treat such data as personal data subject to applicable law.

Colorado Privacy Act Profiling Disclosure. We do not engage in profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act.
